The expense of representation is always a consideration at the start of a relationship. The fees and costs vary from one matter to the next and are always described in detail in a written contract at the outset of the representation. Fees and costs are two separate items. Fees are the money earned by the lawyer working on the case for the work. Costs are the monies spent in connection with the claim such as courthouse filing fees, copies and notary fees.
Our fees can be described in five general categories; hourly, contingency, flat fees, blended flat fee and contingency. Except for Contingency matters, a retainer is required in advance for a minimum amount of work and for costs.
HOURLY FEES
Hourly fees are usually for legal matters such as protracted litigation, drafting of documents or negotiations. The hourly rates are described in advance for the lawyers, paralegals or assistants expected to work on the matter. Often there is a schedule or threshold set at the beginning, and when the schedule or threshold is reached, the client gets advised of the status of the case before continuing. This process helps to manage the total expense for the client.
CONTINGENCY FEES
Contingency matters usually involve a recovery of money and are most often associated with accident claims. We only get paid if there is a recovery, and the recovery is divided between the client and us.
FLAT FEES
Flat fees are often for routine matters, such as a real estate closing, personal bankruptcy, review of a simple contract, office or phone consultation, and other matters.
BLENDED FLAT FEE AND CONTINGENCY FEE
Blended Flat fee and Contingency matters often involve recovery of money in a business or commercial setting. There is a minimum fee for the work at the outset of the case and additional fees may due depending on the result.
